Abstract

There is no provision in the Code of Criminal Procedure specifically barring a second application for bail under section 498 of the CrPC. Until 22.10.2012, there has been no such rule in dealing with filing a second bail application under section 498. Chapter VIA, Rule 3(7)(b) and (c) of the Supreme Court of Bangladesh (High Court Division) Rules, 1973 specifically sets out two preconditions for filing a second bail application, namely (i) specific reference to the previous application and (ii) new grounds. Therefore, filing second bail application is not barred by the High Court Rules.
